Annoyed with ED summoning, TMC leader Abhishek moves SC
The summons has been issued related to some money laundering case where ED wants a couple to present in Delhi for questioning.
New Delhi: Upset with the frequent receipt of summons from Enforcement Directorate (ED), TMC MP and nephew of Chief Minister Mamata Banerjee, Abhishek Banerjee, and his wife Rujira have filed a petition before the Apex Court against the summons.
The summons has been issued related to some money laundering case where ED wants a couple to present in Delhi for questioning.
The couple has challenged the order of Delhi HC which had dismissed the petition in the same matter on March 11.
The couple have appealed to the SC to quash the summons and stop the agency from asking a physical presence for a probe.
The couple said that the ED office of Kolkata also can question them.
The couple wants to know whether the ED has jurisdiction anywhere in the country to summon a person for questioning at Delhi.
The petition has said that the High Court has failed to appreciate that the couple are permanent residents of Kolkata and the entire alleged cause of action and the place of the alleged offense, is in the State of West Bengal.
Stating that the search operation by ED held in WB and other formalities by the ED were also completed in WB only.
Seeking relief from the appearance in Delhi, the plea stated, "Direct the Respondent (ED) to summon the Petitioners under Section 50 PMLA only at Kolkata (for Petitioner no. 1 -Abhishek Banerjee) or only at their residence (for Petitioner no. 2 - Rujira Banerjee), as the case may be, during the pendency of the present proceedings."
Abhishek Banerjee was questioned in the past for eight hours straight by ED officials when he last appeared at the agency office in Delhi in September 2021.
Banerjee said he belongs to TMC and was a leading figure in West Bengal; he said that the entire case against the couple is nothing but a political witch-hunt.
The ED had claimed that the TMC MP was a beneficiary of funds obtained from this illegal trade. Banerjee has denied all charges.
