Special court directs Lokayukta police to reinvestigate denotification case against bsy
Bengaluru: The Special Court for People’s Representative directed the Lokayukta police to reinvestigate the denotification case against the Chief Minister B.S.Yediyurappa.
While allowing the petition filed by complainant Vasudeva Reddy, Special court judge, Sridhar Gopal Krishna Bhat rejected the B report filed by Lokayukta police in the case, further he directed the Lokayukta DySP to investigate the case as per the directions of the High Court.
Mr. Yediyurappa has denotified a land in Bellanduru and Deverabisanahalli for IT park. Vasudeva Reddy had filed a case against him before the Lokayukta seeking prosecution of the Chief Minister.
In January 6, 2021, High Court has dismissed the petition of Yediyurappa seeking quashing of FIR filed by Lokayukta police in denotification case.
High court has observed that there is a priam facie appeared to be against Yediyurappa, who allegedly denotified of land in Bellanduru.
Order
While rejecting the B report, the special court has stated that "B report submitted by the investigation officer under section 173(2) of Cr.P.C is hereby rejected. Consequently, acting under section 156(3) of Cr.P.C, the Deputy Superintendent of Police attached to the police wing of Karnataka Lokayukta is hereby directed to investigate the matter further in the light of the observation made in this order and to file a final report and additional report expeditiously as per law".
" The Investigation Officer shall keep in mind the observations made by the High Court in W.P.No.5043/2019 with regard to the delay in conducting an investigation. The Office is hereby directed to send the copy of this order to the learned ADGP, Lokayuktha, Bengaluru, for further necessary action". Further court has directed Lokayukta police to file a report by August 21, 2021.
