SC directs NTA to grant remedies

New Delhi: The Supreme Court has asked National Testing Agency (NTA) to grant relief to disable students who wrote the National Eligibility cum Entrance Test (NEET).

NTA has denied the students to give one-hour extra time to write NEET, though it was manded under the Rights of Persons with Disabilities Act, 2016.

A division bench headed by Justice D.Y. Chandrachud and Justice Vikram Nath observed that it was left to the authorities concerned to how can provide best remedies to the petitioners, however, the bench has denied the petitioner’s prayer for seeking re-exam.

"The exam body was bound to follow the rules which allow for relaxation for persons with disability. Lack of remedy will cause irreparable injury. Authority cannot be allowed to get away."

Court has directed the National Testing Agency (NTA) to see what remedy can be made available to rectify its injustice meted out to the petitioner, who suffered from Dysgraphia, a neurological disorder that impairs writing.

"Having regard to Vikash Kumar judgment, facilities to persons with disabilities will not be limited in comparison to benchmark disability. The second respondent was unaware of facilities for the petitioner. Thus they should be sensitised," the Court stated.

The Court thus gave the exam authority two weeks to communicate a decision on relief to the petitioner.
