SC refuses to urgently list Hijab row plea

New Delhi: The Supreme Court on Thursday declined to urgently list a plea seeking transfer of the petitions from Karnataka High Court relating to Hijab row to the apex court.

Supreme Court said the High Court HC is getting the matter today (Thursday), asked why it should interfere at this stage. It refused to give any specific date.

Senior Advocate Kapil Sibal mentioned before the SC Bench led by CJI Ramana, "This deals with whats happening in Karnataka, its spreading in entire country." 

Sibal requested the apex court to list the plea. "I’m not asking for Order. If HC doesn’t do anything you can then transfer," said Sibal. 

"Please wait, let HC decide, they are hearing", said CJI Ramana. 

The Karnataka High Court on Wednesday referred the batch of petitions to a larger bench a batch filed by Muslim students seeking wearing of hijab in colleges. Justice Krishna S. Dixit has observed that since petitions have involved larger issues including constitutional matter.

"I feel this matter requires consideration of larger bench. The wisdom emanating from neighbouring High Court judgments needs to be treated," the Court said.

Senior advocates Sanjay Hegde and Devadatta Kamat representing the petitioners requested the court to grant an interim order allowing the students to attend the classes.

The constitutional bench of the Karnataka high court will resume today the hearing of the batch of petitions seeking the wearing of hijab in the schools and colleges. A bench comprising chief justice Ritu Raj Awasthi, Justice Krishna B. Dixit and Justice Sushree Khazi Jayabunnisa will hear the petitions today afternoon in the court hall one.
